Terms of Service
1. Agreement and Who We Are
These Terms of Service (“Terms”) are a legally binding agreement between you and the operator of Fantarise, [Operator legal name], [Registered address], [Company ID (IČO), if any] (“we,” “us,” or “our”). They govern your use of the Fantarise mobile game, including its updates, content, virtual items, online features and player support, and of the website at fantarise.com (together, the “Services”).
By creating an account, signing in, or otherwise using the Services, you confirm that you have read and accept these Terms. Our Privacy Policy explains how we handle personal data. If you do not agree to these Terms, do not use the Services.
Rules and descriptions shown inside the game, such as event rules, offer details and probability disclosures, form part of these Terms. If they conflict with these Terms, the more specific in-game rule applies to that feature.
2. Eligibility and Minors
- You may use the Services only if you are at least 13 years old, or older if your country sets a higher minimum age for using online services or consenting to the processing of personal data.
- If you are under the age of legal majority in your country, a parent or legal guardian must read and accept these Terms on your behalf. By allowing a minor to use the Services, the parent or guardian accepts these Terms and is responsible for the minor's activity, including all purchases.
- We strongly recommend that parents use the purchase controls provided by the device and app store, such as Ask to Buy and Screen Time on iOS, or purchase authentication and Family Link on Google Play.
- You may not use the Services if applicable law prohibits you from doing so, or if we have previously banned your account, unless we expressly allow it.
3. Your Account
Creating an account
To play, you need an account. You can sign in with an email address and password, or with a supported third-party account such as Google or Apple. The information you give us must be accurate. Each account is for one person only.
Keeping your account secure
You are responsible for keeping your login details confidential and for all activity that happens under your account. Tell us immediately at the contact address below if you believe someone has accessed your account without permission. Except where the law provides otherwise, we are not responsible for losses caused by your failure to protect your login details.
Accounts are personal
Your account, characters, progress and virtual items are personal to you. You may not sell, buy, rent, share, gift, lend or otherwise transfer them, or offer to do so, whether inside or outside the game, including on third-party websites and marketplaces. We may close accounts involved in any such transfer.
Game servers
The game runs on several regional servers. One account may hold separate characters on different servers. Progress and virtual items belong to the server where they were obtained and generally cannot be moved between servers.
Deleting your account
You can delete your account at any time in the game under Settings → Delete account. Deletion is permanent and cannot be undone. All characters, creatures, progress, virtual items and unused virtual currency are lost, without refund or compensation except where the law requires otherwise. We may keep limited records after deletion, such as purchase records needed to handle refund disputes and data used to prevent fraud and abuse of the invite programme, as described in our Privacy Policy.
Inactive accounts
We may delete an account that has not been used for 36 consecutive months, in line with our Privacy Policy. Where reasonably possible, we will notify you before doing so.
4. Character Names and Player Content
Your character name and parts of your profile, such as your avatar, titles and showcased creatures, can be seen by other players, for example on leaderboards and public profiles. You are responsible for everything you submit through the Services (“Player Content”), including your character name, bug reports and messages to support.
Name rules
Character names and other Player Content must not:
- contain profanity, obscenities, or vulgar or sexual language in any language, including misspellings, abbreviations, look-alike characters, numbers or spacing used to get around this rule;
- be hateful, discriminatory, harassing or threatening, or refer to violence, self-harm, terrorism, extremist groups, illegal drugs or other illegal activity;
- impersonate, or suggest a connection with, us, our staff or moderators, another player, or any real person, brand or organisation, for example names containing “Admin”, “Moderator”, “GM”, “Support” or “Fantarise”;
- contain personal information, such as real names of others, phone numbers, email or home addresses;
- advertise anything, or contain links, social media handles, or offers to sell accounts, currency, items or cheats;
- infringe anyone else's rights, such as trademarks or copyrights; or
- otherwise be offensive, or unsuitable for a general audience that includes teenagers.
If a name breaks these rules, we may, without prior notice, replace it with a neutral or randomly generated name, require you to choose a new one, or restrict your account. Severe cases, such as hate speech or sexual content, and repeated cases may lead to suspension or a permanent ban without warning, as described in Section 12. We decide whether a name breaks these rules, acting reasonably and in good faith.
Licence to Player Content
You keep any rights you have in your Player Content. You grant us a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence to use, store, display, reproduce, modify and distribute it for as long as needed to operate, provide, improve and promote the Services. If you send us ideas or feedback, we may use them freely without any obligation to you. We may remove Player Content at any time.
5. Licence and Ownership
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the game on devices you own or control, for your own non-commercial entertainment. The game is licensed, not sold.
We and our licensors own all rights in the Services, including the software, art, characters, creatures, names, story, music, sounds, logos, trademarks, virtual items and all account data. Except for the licence above, these Terms give you no rights in the Services. Unless the law expressly allows it, you may not copy, modify, translate, decompile, disassemble or reverse engineer the game, create derivative works, extract data from it, get around any technical protection, use the Services commercially, or use our names and logos.
6. Virtual Currency and Virtual Items
The game contains virtual currencies, including Seraphite (premium currency that can be bought with real money and is also awarded in the game) and Emberstone (earned through gameplay or exchanged for Seraphite), and other virtual items such as creatures, eggs, chests, equipment, Ascension Sparks, incubators, teleports, character skins and bundles such as starter packs (together, “Virtual Items”).
A licence, not property
- Virtual Items are part of the licence in Section 5. You do not own them, and they are not your property.
- Virtual Items have no monetary value. They are not money, electronic money, a deposit or a payment instrument. They cannot be redeemed or exchanged for money, goods or anything of monetary value, from us or anyone else, and they do not earn interest.
- Virtual Items can only be used in the game, on the server where they were obtained, and only as the game allows.
- You may obtain Virtual Items only through the game itself and the official app stores. Buying, selling, trading or transferring Virtual Items outside the game, for real money or anything else, is prohibited. Any such transaction is void and may lead to the measures in Section 12.
Changes to Virtual Items and the game economy
To keep the game balanced, fair and working, we may change, rebalance, rename, reprice, limit or remove Virtual Items and any part of the game economy at any time. This includes prices, exchange rates such as Seraphite to Emberstone, drop rates, rewards, and the strength of creatures and equipment. Such changes may affect the usefulness or perceived value of Virtual Items you already have. We will act reasonably and will not take away the main benefit of paid content without a valid reason. Where mandatory consumer law gives you rights because a change significantly harms your use of paid digital content, for example the right to end the contract or receive a refund, those rights are not affected.
Mistakes
If Virtual Items are credited to your account by mistake, for example because of a bug, a server error, a wrong price or a duplicated reward, we may correct your balance or remove those Virtual Items, even if you have already used them.
Loss of Virtual Items
Except where the law requires otherwise, we do not refund or compensate for Virtual Items that are lost when your account is deleted, closed or banned under these Terms, or when the Services end.
7. Purchases and Refunds
App store purchases
In-game purchases are made through the Apple App Store or Google Play and are subject to their terms and payment policies. The store processes your payment; we do not receive your card details. Prices are shown in the store in your local currency, including any applicable taxes. We may change prices, run limited-time offers and set purchase limits. One-time offers, such as the Eldara Starter Pack, can be bought only once per account.
Delivery
After the store confirms your payment, we verify the purchase and credit the Virtual Items to the account you are signed in to. If something does not arrive, use “Restore purchases” in the Market or contact us with your store receipt. Make sure you are signed in to the right account and server before buying; we cannot always move purchases between accounts or servers.
Purchases are final
Except where the law or the store's refund policy says otherwise, all purchases are final and non-refundable, including when Virtual Items have been partly used. Because Apple and Google process the payment, refund requests must be made to them under their policies. We cannot issue refunds for app store purchases ourselves.
Right of withdrawal (EU, EEA and UK consumers)
Consumers in the EU, EEA and UK normally have 14 days to withdraw from an online purchase. Virtual Items are digital content that is not supplied on a physical medium, and we deliver them immediately after purchase. By completing a purchase, you expressly request immediate delivery and acknowledge that you lose your right of withdrawal once the Virtual Items are delivered to your account. This does not affect your rights if the content is faulty or is not delivered.
Refunds, reversals and chargebacks
If a payment is refunded, cancelled, reversed or charged back, or turns out to be unauthorised or fraudulent, we may remove the Virtual Items from that purchase and anything obtained with them, even if this leaves a negative balance. If refunds or chargebacks are abused, for example by requesting refunds after using the Virtual Items, we may also suspend or close the account.
Purchases by minors
Parents and guardians are responsible for purchases made by minors in their care. Requests for refunds of unauthorised purchases made by a child must be sent to Apple or Google, under their policies.
8. Chests, Eggs and Other Random Rewards
Some Virtual Items, such as chests and eggs, give a randomly selected reward. The game shows the probability of each possible reward or rarity before you buy or open such an item. The probabilities shown at the time of opening apply. Unless the game says otherwise, each opening is independent, so there is no guarantee of getting a particular reward. Every opening gives you a Virtual Item, and rewards have no monetary value and cannot be exchanged for money. Where local law restricts paid random rewards, we may limit or disable them in that country.
9. Rewarded Advertisements
The game may let you watch optional advertisements in exchange for rewards, such as a free chest or a speed-up. A reward is granted after the advertising partner confirms that the ad was watched. Ads may be limited by cooldowns, and may not always be available. Advertisements are supplied by third parties, and we are not responsible for their content or for the products they promote. Using tools to fake, skip or automate ad views is prohibited.
10. Invite Friends Programme
- Each player can share a personal invite code. If a new player enters your code within the time allowed in the game after creating their account, and then reaches the required level, you may receive the reward shown in the game, up to the maximum number of rewarded friends. The current conditions, such as the time limit, the level and the reward, are shown in the game.
- Only genuine new players count. You may not invite yourself; create, buy or use additional accounts or devices; use bots, emulators or device or location spoofing; buy, sell or trade codes; send spam; or promote your code in a misleading way or in breach of other platforms' rules.
- We may check eligibility, and withhold, reverse or remove rewards obtained in breach of these rules. We may also take the measures in Section 12 against the accounts involved.
- We may change, suspend or end the programme at any time. Rewards that were legitimately granted before then stay in your account.
- Invite rewards are Virtual Items and have no monetary value.
11. Fair Play and Rules of Conduct
You agree that you will not, and will not help or encourage anyone else to:
- Cheat: create, use or distribute cheats, hacks, mods, trainers, bots, macros, scripts, automation, or any unauthorised third-party software that changes or interacts with the game or gives you an unfair advantage.
- Exploit bugs: deliberately use any bug, glitch, error or unintended game mechanic (an “exploit”) to gain an advantage or Virtual Items. This includes duplicating items, generating currency, skipping timers, manipulating leaderboards or affecting other players, as well as sharing exploits with others instead of reporting them. If you find a bug, stop using it and report it promptly in the game under Settings → Report a bug, or by email.
- Tamper with the Services: modify, decompile, intercept or manipulate the game, its network traffic, save data or our servers and interfaces; change your device clock to skip timers; or access the Services by any means other than the official app.
- Manipulate rankings: influence leaderboards, rankings or rewards by any means other than ordinary play.
- Misuse accounts: use multiple accounts to gain advantages, for example in the invite programme, or to get around a sanction; or use someone else's account.
- Trade for real money: buy, sell or trade accounts, Virtual Items or services such as boosting or levelling, for real money or anything else outside the game.
- Commit fraud: use stolen or unauthorised payment methods, or abuse refunds and chargebacks.
- Abuse others: harass, threaten or abuse other players or our staff, or impersonate us.
- Disrupt the Services: overload or attack our servers, spread malware, or try to access accounts, systems or data without authorisation.
- Break the law: use the Services for any illegal purpose or in breach of these Terms.
12. Enforcement: Suspensions and Bans
To protect the game and its players, we may monitor gameplay, transactions and technical data, as described in our Privacy Policy. If we reasonably believe that you have broken these Terms, including the name rules in Section 4 and the rules of conduct in Section 11, or that your account is being used in a way that harms the Services, other players or us, we may take one or more of the following measures. We will choose them in proportion to the seriousness of the breach.
- a warning;
- resetting or changing your character name or other Player Content;
- removing, resetting or reversing Virtual Items, currency, progress, rewards or rankings obtained through or affected by the breach, including rolling the account back to an earlier state;
- removing you from leaderboards, or restricting features such as purchases or the invite programme;
- temporarily suspending your account;
- permanently banning (disabling) your account, and blocking devices linked to it;
- reporting illegal activity to the relevant authorities.
Exploiting bugs
Deliberately exploiting a bug is a serious breach. Depending on its scale and effect, and whether you reported it, we may remove all gains, roll the account back, suspend it or ban it permanently. Players who come across a bug by accident and report it promptly and in good faith will not be penalised, although we may still correct their balances.
Serious or repeated breaches
For serious breaches, such as cheating, deliberate exploiting, fraud, account trading, hate speech or sexual content, and for repeated breaches, we may permanently ban an account immediately and without prior warning.
Consequences
If your account is suspended or banned for breaking these Terms, you may lose access to it and to all Virtual Items in it, including unused Seraphite and items bought with real money, without refund or compensation, except where the law requires otherwise. You may not create or use another account to get around a suspension or ban.
Notice and appeals
Where the law requires it, including the EU Digital Services Act, we will tell you about a restriction and the main reasons for it, unless doing so would compromise an investigation or the security of the Services, or is prohibited by law. If you believe we made a mistake, you can appeal within six months by emailing us with your character name, your server and an explanation. A person will review the appeal promptly and fairly, and we will reverse the measure if it was not justified. You also keep any other remedies that the law gives you, including, in the EU, certified out-of-court dispute settlement bodies and the courts.
13. Updates, Availability and End of Service
- Fantarise is a live, online game. We may update it and add, change or remove features, content, game modes and servers. You may need to install updates to keep playing, and system requirements may change.
- The Services require an internet connection. Any data charges from your provider are your responsibility.
- We do not guarantee that the Services will always be available or error-free. Maintenance, outages and interruptions can happen. We may offer in-game compensation for disruptions at our discretion, but we are not obliged to do so.
- We may stop operating the game, or a particular server, at any time. Where possible, we will give at least 60 days' notice in the game or on fantarise.com, and we will stop selling Virtual Items for real money from the time of that notice. When the Services end, your licence to use the game and Virtual Items ends too. Unused Virtual Items are not refunded, except where the law requires otherwise.
14. Third-Party Services
The Services rely on third parties, including Apple, Google, sign-in providers, cloud hosting and analytics providers, and advertising partners. Your use of their services is governed by their own terms and privacy policies, and we are not responsible for them. If you downloaded the game from Google Play, Google Play's terms also apply, but Google is not a party to these Terms.
15. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available”. We give no warranties, express or implied, including that the Services will be uninterrupted, error-free or secure, that data or progress will never be lost, or that they will be fit for a particular purpose. Nothing in these Terms affects your statutory rights as a consumer, including the legal guarantee that digital content will conform to the contract under EU and national law.
16. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or Virtual Items. Our total liability arising from or relating to the Services is limited to the greater of (a) the amount you paid for in-game purchases in the 12 months before the claim arose, and (b) 50 euros.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally or through gross negligence, or any other liability that cannot be limited or excluded by law. If you are a consumer in the EU, EEA, UK or Switzerland, this section applies only to the extent permitted by the mandatory law of your country of residence.
17. Indemnity
To the extent permitted by law, you agree to compensate us for claims, losses and reasonable costs, including legal fees, arising from third-party claims caused by your breach of these Terms or your misuse of the Services. This does not apply where the law prohibits such an obligation for consumers.
18. Term and Termination
These Terms apply for as long as you use the Services. You can stop at any time, and you can delete your account as described in Section 3. We may end these Terms or your access to the Services under Section 12, or when the Services end under Section 13. Sections that by their nature should continue to apply after termination will continue to apply, including those on ownership, Virtual Items, disclaimers, liability and governing law.
19. Changes to These Terms
We may update these Terms to reflect changes to the Services, to the law, or to our business. We will publish the updated Terms on this page with a new “Last updated” date. For material changes, we will give reasonable advance notice in the game or on fantarise.com, at least 30 days where possible, unless a change is required sooner by law or for security reasons. If you keep using the Services after the changes take effect, the updated Terms apply. If you do not agree to them, stop using the Services and delete your account. Changes do not apply retroactively to disputes that arose before they took effect.
20. Governing Law and Disputes
- These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
- If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you live. Nothing in these Terms affects your right as a consumer to rely on those provisions.
- Please contact us first. Most issues can be solved quickly, and we will try to resolve any complaint informally within 30 days.
- The courts of the Czech Republic have jurisdiction over disputes. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and in the EU you can only be sued there.
- Consumers may use out-of-court dispute resolution. The body competent for consumer disputes with us is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, adr.coi.gov.cz. Consumers in other EU countries can also get free help from the European Consumer Centre in their country.
- To the extent permitted by law, claims may be brought only on an individual basis, not as a plaintiff or class member in a class or representative action. This does not limit the rights of consumer organisations under applicable law.
21. Additional Terms for Apple Devices
If you downloaded the game from the Apple App Store, the following also applies:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the game and its content.
- Your licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may be accessed by other accounts associated with you through Family Sharing.
- Apple has no obligation to provide any maintenance or support for the game.
- If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the game.
- We, not Apple, are responsible for handling any claims relating to the game or your use of it, including product liability claims, claims that the game fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar laws.
- If a third party claims that the game or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
22. General
- Entire agreement. These Terms, together with the Privacy Policy and the rules shown in the game, are the entire agreement between you and us about the Services.
- Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right immediately, we may still enforce it later.
- Assignment. We may transfer our rights and obligations under these Terms to another company, for example if the game is sold, provided this does not reduce your rights. You may not transfer your rights or obligations.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may contact you in the game, by email, or on fantarise.com.
- Language. These Terms may be offered in several languages. If versions differ, the English version prevails, unless the mandatory law of your country of residence requires otherwise.
